Current immigration law is based on the Immigration and Nationality Act of 1965. While the framework of immigration law remains under Common Law characteristics, immigration policies change continuously depending on the ruling party. Seoul Immigration confirms the following points before signing a contract.
Nationality
We do not accept applications if the main applicant was born in China or India due to processing delays (backlog).
We do not accept applications if the country is currently designated as a US entry ban or partial entry restriction country.
- US Entry Ban Countries: Afghanistan, Myanmar, Chad, Congo, Equatorial Guinea, Eritrea, Haiti, Iran, Libya, Somalia, Sudan, Yemen
- Partial Entry Restriction Countries: Burundi, Cuba, Laos, Sierra Leone, Togo, Turkmenistan, Venezuela
Disease Status
Diseases apply to all family members entering.
To avoid "public charge" issues where immigrants might deplete US resources due to health or age problems, the US Department of State has sent guidelines to embassies and consulates worldwide allowing consular officers to deny US immigrant visas in cases of contagious diseases, as well as diabetes, obesity, cardiovascular diseases, etc.
Major diseases: Cardiovascular disease, respiratory disease, cancer, diabetes, metabolic disease, neurological disease, mental health conditions, and diseases requiring excessive medical costs.
Criminal Record
Applicants over 16 must submit a police certificate if they have lived in their country of nationality for more than 6 months. Also, if the current country of residence is different from nationality and they have lived there for more than 6 months, a police certificate is required. If they have lived in another country for more than 1 year, a police certificate from that country is also required.
Crimes involving moral turpitude (including DUI), drug-related crimes, or 2 or more crimes with a total sentence of 5 years or more may result in visa denial. In some cases, a waiver application may be possible.
- Crimes Involving Moral Turpitude (CIMT): Petty crimes, sentences of 6 months or less, maximum sentence for crime is 1 year or less.
- Juvenile Crimes: Criminal record under 18 with one offense, completed sentence more than 5 years ago.
- Cases of extreme hardship or serious difficulties like illness.
Accompanying Child Age (CSPA)
The age for accompanying children for US permanent residency is 20. Age calculation is based on the Child Status Protection Act (CSPA).
In other words, the child's age is determined based on the interview availability date in the Visa Bulletin, deducting the USCIS petition review period from their age.
Priority Dates if Employer Changes

Employer Change during DOL PERM or USCIS I-140:
Priority date resets and the new PERM filing date becomes the priority date. Therefore, it's best not to change employers during LC and I-140 processing. -
Employer Change after I-140 Approval:
The priority date of the approved I-140 can be ported to the new I-140. -
Employer Change at I-485 Stage (AC21 Rule):
If 180 days have passed since I-485 (Adjustment of Status) filing, changing to a new employer is possible. However, it must be the same occupation.
US Entry & Exit
Theoretically, there are no issues with US entry/exit after I-140 filing and before I-485 filing. However, re-entry requires careful preparation of valid visas, intent, and documents. Immigration intent is subject to officer discretion, so caution is needed.
If processing from outside the US, obtaining a student visa after I-140 filing can be very difficult, so expert consultation and preparation for student visa application timing are required.
ESTA Issuance
While issuing ESTA after filing I-140 is systematically possible, entry requires caution. If immigration intent is revealed to CBP/Immigration, ESTA issuance may be denied. In this case, proving no immigration intent for a B1/B2 visa interview is required, but the likelihood of acceptance is very low.
